Terms of Purchasing and Shipping

1. Title and Risk of Loss

Title to the Equipment and all risk of loss shall pass to the Buyer upon receipt of full payment and availability of the Equipment for pickup at the Seller’s location.

2. Logistics and Transfer Terms

The Equipment is sold “as is, where is,” without warranty, express or implied, including but not limited to any warranty of merchantability or fitness for a particular purpose.

The Buyer shall be responsible for arranging and paying for the pickup, loading, transportation, and delivery of the Equipment, providing all labor, equipment, and materials necessary for removal and ensuring proper safety and compliance during transport.

The Seller shall not be liable for any damage, loss, delay, or injury arising from or related to the Buyer’s handling, loading, or shipping of the Equipment.

The Seller will permit access for removal during mutually agreed-upon business hours, provided the Buyer gives reasonable advance notice. Any damage to Seller’s property during removal shall be the responsibility of the Buyer.

3. Inspection and Acceptance

The Buyer acknowledges that they have had the opportunity to inspect the Equipment or have voluntarily waived the right to do so. The Seller warrants that the Equipment was in good working order at the time of electrical and plumbing disconnect from Seller facilities. Buyer accepts the Equipment in its current condition and affirms that no warranties or representations other than those expressly set forth herein have been made by the Seller.

4. Entire Agreement

The Bill of Sale, incorporated into the terms when purchasing through this site, constitutes the entire agreement between the parties. No oral statements or prior written material not specifically incorporated herein shall be of any force and effect. Any modifications must be in writing and signed by both parties.

5. Governing Law

The Bill of Sale, incorporated into the terms when purchasing through this site, shall be governed by and construed in accordance with the laws of the State of Maine, without regard to its conflict of law principles.
